TERMS & CONDITIONS


Snorkel and Dive Trips


Cancellations, transfers or non-attendance

Where MAGNETIC ADVENTURE DIVERS PTY LTD (PRO DIVE MAGNETIC ISLAND) cancels an event a full refund or alternative dates will be offered.

If you cancel your dives, on or within three (3) days of the start date, no refund will be given.

If you cancel your dives more than three (3) days from the start date, a refund will be given, less $50 administration fees.

If you fail to attend your scheduled dive, no refund will be given; rebooking will be at full cost.

It is your responsibility to get to the check-in point on time. If you fail to attend due to late arrival, the above condition applies.

You may transfer your dives to a new date once, free of charge, with more than three (3) days notice. Any subsequent changes will incur a $100 re-booking fee.

Transfers made on or within three (3) days of the start date will incur a $100 fee. No exceptions.

If a medical condition temporarily prevents you from completing the dives, the above conditions apply.

If a medical condition permanently prevents you from completing the dives, the above conditions apply.

You may transfer your dive to a friend or family member at any time for a $100 rebooking fee.

If you fail to complete both dives during the scheduled time, the remaining dive(s) are forfeit.

The above terms also apply to voucher bookings.

Vouchers, discounts and special offers must be applied at time of purchase.

Dive Site Guarantee – Magnetic Adventure Divers Pty Ltd (Pro Dive Magnetic Island) retain the right to change our planned dive site should prevailing sea conditions or weather conditions make it unsafe for diving. In these circumstances, no refunds will be offered should the diver decide not to proceed with the dive.

Trips are subject to minimum numbers and appropriate weather conditions.

MAGNETIC ADVENTURE DIVERS PTY LTD (PRO DIVE MAGNETIC ISLAND) will endeavour to confirm all boat trips the day prior on review of the latest weather forecast but reserves the right to cancel dive trips at any time. 

All customers are required to call between 3-4pm the day prior to their trip to confirm if the trip can proceed.

*All Prices are Per Person and Prices may vary depending on Start Dates.


Certified Diver requirements

You must be a certified diver (open water minimum)

You must have dived within the last 12 months.

If you are not a confident diver or have not dived within 12 months then we highly recommend booking a guided shore dive or refresher dive before our guided boat dives. This is for your own safety and comfort as well as for the safety and comfort of the other customers diving with you.

Proof of certification must be presented before the dive.

You must be medically fit to dive. 

Additional requirements apply for SS Yongala Trip.

You will be required to sign our Liability Waiver for the activity upon arrival.

Suppose you fail to meet any of the above requirements on the day. In that case, PRO DIVE reserves the right to refuse diving and dive related activities. No refund will be given and rebooking will be at full cost

Our tours are subject to the risks and perils of scuba diving in changeable conditions in an open water environment. We have a duty of care to ensure that your dive experience is enjoyable and safe, therefore we reserve the right, for our customer’s safety and/ or the safety of our crew or other scuba divers, to prevent any customer’s participation in scuba diving if they are deemed physically or medically unfit to do so or in our sole discretion.

We strongly recommend a wait of 24 hours before flying after diving.


Dive Equipment

Certified divers choosing to use their own dive equipment must ensure that all equipment is in good working condition and serviced within the last 12 months. MAGNETIC ADVENTURE DIVERS PTY LTD (PRO DIVE MAGNETIC ISLAND) are not responsible for any faults or damage to customers personal equipment and do not carry spare equipment for divers using their own dive equipment. If divers are not able to complete dives due to faults with their own personal dive gear no compensation will be offered.


Medical Requirements

Certified Divers: As a certified diver you will be required to complete a medical statement. If you suffer from a medical condition or your health has changed since you completed your dive course, you may be required to provide a letter from your doctor stating that you are fit to dive – please request more information if this is the case.

Non-Certified Divers: As a non-certified diver you will be required to complete a medical statement. Certain health conditions may prohibit you from participating in scuba diving activities or require you to provide a certificate from a diving pysician stating that you are fit to dive prior to particiaption – please request more information if this is the case.  

Snorkellers: Snorkellers are advised that snorkelling can be a strenuous physical activity even in calm water and that older people are at an increased risk of death and injury due to a higher incidence of medical conditions made worse by physical exertion, such as heart disease and stroke.  Therefore anyone with an increased risk due to age or existing health conditions are advised to seek medical advice prior to participating in snorkelling activities. 

Snorkelling is not suitable for non-swimmers. 

NOTE: All medical cancellations must be accompanied by a medical failure notification from the doctor, word of mouth will not be accepted.


Minimum Age

Our minimum age for our Great Barrier Reef tours is 10yrs+ for snorkellers and 12yrs+ for divers

The minimum age for our Yongala Dive tours is 15 years old

Under 18’s must be accompanied by an adult and have a parental waiver signed by parent/guardian.


Spoken Languages

English is the language spoken on board our tours.


Dive Courses


Cancellations, transfers or non-attendance

If you cancel your course, on or within 7 days of the start date, no refund will be given.

If you cancel a course with more than 7 days notice, a refund will be offered, less $100 fee.

If you fail to attend your course, no refund will be given; rebooking will be at full cost.

You may transfer your course to a new date once, free of charge, with more than 7 days notice.

Transfers made between 24hrs and 14 days of the start date will incur a $100 fee. No exceptions.

Any cancellations made within 24hrs of your course start time will result in forfeit of the course and rebooking will be at full cost.

If you have indicated yes to any of the questions on the Dive Medical, then a medical certificate will need to be provided at time of booking or prior to the course start date, stating you are ‘fit to dive’ unconditionally. Failure to do so will result in forfeit of the course and rebooking will be at full cost.

In the case of a failed Dive Medical, a medical signed by a qualified diving physician stating that you are medically unfit to dive must be provided 7 days prior to the course beginning in order to secure a refund.

If an emergency medical condition manifests within 24hrs of your course start time, proof must be provided in order to transfer your course at the reduced rate of $100.00.

If a medical condition manifests outside of 24hrs and temporarily prevents you from completing the course, the above conditions apply.

You may transfer a course to a friend or family member at least 24hrs before the start time for a $100 rebooking fee.

If you have signed up for the Scuba Schools International (SSI) online training more than 90 days prior to your cancellation or transfer, the cost of the training will also be deducted from any refunds.

If you fail to complete the course during the scheduled time, a fee of $100 is payable to complete the course at a later date.

Any courses purchased through a special offer or discounted price are strictly non-refundable. You may however, transfer the course to a friend or family member; the above conditions apply.

All fees are per person.

Course requirements

Failure to adhere to all of the pre-course requirements found on your voucher (including completion of any online training and the online medical questionnaire) will result in cancellation of the course. No refund will be given, and rebooking will be at full cost.

You must be able to swim 200m and tread water for 10 minutes. Failure to perform these swim tests within the allocated time frame will result in course cancellation without refund and rebooking will be at full cost.

All courses must be complete within 90 days of the original start date.


Minimum Age

Our minimum age for Learn to Dive programs is 12yrs+

Under 18’s must have a parental waiver signed by parent/guardian on day one of the course.


Spoken Languages

All verbal instructions are in English only and you are required to be proficient in English. No translation services are available or can be used during the course and other students cannot translate on behalf of the instructors.


Insurance

All passengers/students are strongly advised to purchase a comprehensive Travel Insurance policy that covers:

  • Trip / Course Cancellation
  • Lost / damaged personal belongings or equipment, due to any reason, and
  • Evacuation and Medical cover (if Scuba Diving ensure this is covered in the policy)

Note: In a medical emergency, any evacuation, vessel relocation or medical expenses are the financial responsibility of that passenger.


Liability Release and Waiver

The laws of Queensland apply in relation to these Terms and Conditions and our business.

It is a fundamental condition of this contract between you, and/or your client and us, that to the extent permitted by law, we (including our directors, employees, agents and independent contractors) are discharged and indemnified by you /or your client (including by your / or your clients executor(s), administrator(s) and dependent(s)) from any liability for any loss, damage, death or injury whatsoever arising out of, or incidental to, this diving or snorkeling trip and other services provided by us, whether or not such damage or personal injury is caused or contributed to by us.

You/or your client acknowledge and agree that:

  • They will be participating in activities, which are undertaken for the purposes of recreation and involve a significant degree of physical exertion and/or physical risk;
  • They are aware of the risks of injury associated with your participation in this diving or snorkeling trip and agree to voluntarily assume such risk; and
  • The use of any equipment hired or loaned by us is entirely at their own risk.
  • Notwithstanding the above, we reserve the right to rely upon any limitation of liability and/or defence available under any applicable law(s) and/or international convention(s) for any claim made by you or your client against us.

Express acceptance of risk

To participate SCUBA diving / Snorkeling ALL Customers are required to agree to, and sign, our Liability and Release of Indemnity forms relevant to the activity they will be undertaking.
